Agreement for the use of Services on or via Mediahuis Domains by Users and Registered Users
This agreement explains how the Mediahuis Group uses the data you share with us to provide a personal and high-quality experience on their websites and apps.
In summary, we collect three types of data:
1/ Data that you share to register, to login to our sites or apps or to receive newsletters,
2/ Click Behaviour from which we can derive interests to show relevant advertisements and to recommend articles in addition to our news offering,
3/ Data that you add yourself to use certain Services. For example: uploading or filling out a CV on Jobat.
This agreement applies to all data collected by the Mediahuis Group through its websites, apps or newsletters. We make a distinction between users with and without a registration.
Within this agreement, it is necessary to use a number of technical terms. That is why we provide a brief overview of the definitions and frequently used terms in this section.
Recommended Content: suggestions for articles, advertisements, job offers and other information that a Mediahuis Entity adjusts to the interests of a User (based on Click Behaviour) or a Registered User (based on Click Behaviour and Registered Data).
Service: news, promotions, functionality for a better user experience, (mobile) apps, Recommended Content or Personalised Advertisements that a Mediahuis Entity provides or makes available on or through a Mediahuis Domain. User: anyone who visits a Mediahuis Domain to use a Service as a consumer. Such a visit can happen directly through our websites or after installing one of our apps.
Personalised Advertisements: commercial information that is tailored to the interests of a User (based on Click Behaviour) or a Registered User (based on Click Behaviour and Registered Data).
Registered User: anyone who registers his/her personal data to create an account with a Mediahuis Domain to use a Service as a consumer.
Registered Data: personal data that a Registered User him-/herself provides to a Mediahuis Entity during registration with the Mediahuis Entity. This data differs per Mediahuis Domain, but usually includes: first name, last name, e-mail address, street, house number, postcode, town, gender, date of birth, preferred newsletters. If you would like to, you can also enter your telephone and/or mobile phone number.
Click Behaviour: the interests of a User or Registered User that are derived by means of cookies and similar technologies from the use of a Service on Mediahuis Domains and from visits and interaction with third party websites. Click Behaviour can be collected for both a User and a Registered User and contains mainly:
• Session data: the operating system, device type and browser. This is necessary to offer you a positive user experience.
• Pages visited in which we differentiate you by your interest areas. We do this by adding keywords to certain sections or articles so that we can show you Featured Content and Personalised Advertisements. (e.g. sports, lifestyle, car enthusiast).
Mediahuis Domain: a website or a(n) (mobile) application offered or operated by a Mediahuis Entity.
Mediahuis Group: the whole of Mediahuis Entities
Mediahuis Enitity: the legal person within the Mediahuis Group who offers/supplies a Service – Mediahuis Entities.
1. Services to the Users
1.1. Subject – If you visit a Mediahuis Domain as a User, then the responsible Mediahuis Entity will offer you the opportunity to gain free access to Services. An overview of the Services available to Users can be found here: Mediahuis Services. The Services available to Users are less extensive than those for Registered Users. If you would like to use the Services as a User, you must accept this agreement so that the responsible Mediahuis Entity can provide you with the Services. Furthermore, you can only read some content as newspaper titles, namely “plus”-articles marked with (+) on the newspaper sites as a subscriber.
1.2. Click Behaviour – As a User you do not have to pay for the available Services. However, the responsible Mediahuis Entity needs access to your Click Behaviour in exchange for the free Services. Your Click Behaviour is also necessary to provide certain Services such as Recommended Content or Personalised Advertisements.
1.3. No obligation – You can always visit a Mediahuis Domain without accepting the agreement as a User, but you will not get access to the Services for Users. This is the agreement that we propose. If you do not accept the agreement, then you will still be able to access certain content, but this will be even more limited. You will still see advertisements, but they will not be adapted to your interests.
2. Services to Registered Users
2.1. Subject – If you visit a Mediahuis Domain as a Registered User, then the responsible Mediahuis Entity will give you the opportunity to gain free access to Services. An overview of the Services available for Registered Users can be found here: Mediahuis Services. The Services available to Registered Users are more extensive than those for Users. If you would like to enjoy the Services as a Registered User, then you must accept this agreement so that the responsible Mediahuis Entity can provide you with the Services. Furthermore, you can only read some content as newspaper titles, namely “plus”-articles marked with (+) on the newspaper sites as a subscriber.
2.2. Click Behaviour and Registered Data – As a Registered User you do not have to pay for the available Services. However, the responsible Mediahuis Entity needs access to your Click Behaviour and Registered Data in exchange for the free Services. Your Click Behaviour and Registered Data are also necessary to provide certain Services such as Recommended Content and Personalised Advertisements.
2.3. No obligation – You can always visit a Mediahuis Domain without accepting the agreement as a Registered User, but you will not get access to the Services for Registered Users. This is the agreement that we propose. If you do not accept the agreement, then you will still be able to access certain content, but this will be even more limited. You will still see advertisements, but they will not be adapted to your interests.
2.4. Visit logged-in – As a Registered User you can only enjoy the Services of a Mediahuis Entity when you visit logged-in to the relevant Mediahuis Domain. You can decide to log-off at any time. In that case, you will not be recognised and your Click Behaviour and Registered Data will not be tracked. At any time, you can decide to login as a Registered User to enjoy the Services again.
The available Services vary per Mediahuis Domain and depend on whether you are a User, Registered User or neither of them (in the latter case you do not wish to enter into a contract).
Each Mediahuis Entity offering which of the Services through which Mediahuis Domains is set out above.
These are the different Mediahuis Services.
4. Duration and termination of the agreement
4.1. Duration – Your agreement as a User or a Registered User is for an indefinite duration. You may terminate the agreement at any time without notice or compensation. Mediahuis may terminate the Agreement at any time with a notice period of 15 calendar days without compensation and by means of a notification.
4.2. End – To terminate the agreement, you must change your cookie setting. (agreement as a User) or delete your account (agreement as a Registered User). You can have your account removed by sending an email to:
• firstname.lastname@example.org for the Services offered by Mediahuis Limburg, Limburgvac and WijNederland, and
• email@example.com for all other Services
After you have terminated your agreement, and if you would like to receive free access to the Services again, then you will have to enter into the agreement again.
4.3. No revocation right – If you register as a consumer, then you acknowledge that you do not have a revocation right under consumer law because the agreement includes the supply of digital content of which the performance starts immediately after you have given your explicit consent. The absence of the revocation right does not affect your right to terminate the agreement at any time by deleting your account (See Articles 4.1 – 4.2).
5. Information based on data protection
7.1. Applicable law and jurisdiction – Without prejudice to any mandatory provisions of any other jurisdiction, only Belgian law applies to this agreement. Without prejudice to any applicable mandatory law that determines that the courts of your domicile would be competent, the courts of the place where our seat is established will be exclusively competent to decide upon disputes regarding these conditions.
7.2. Alternative dispute resolution – If you are a consumer, you may contact the competent Consumer Mediation Service:
• For the Services of Mediahuis Limburg BV, Limburgvac and WijNederland BV: the Nederlandse Ombudsdienst www.nationaleombudsman.nl
• For all other Services of a Mediahuis Entity: the Consumer Mediation Service of the Federal Government: https://www.consumerombudsman.be/en.
Regarding disputes that have a cross-border character, you may call upon the online dispute resolution of the European Commission through the following link: https://ec.europa.eu/consumers/odr/main/?event=main.home.show.
7.3. Modifications – Mediahuis may always modify the terms and conditions of the Agreement and service. If the modifications are substantial, then Mediahuis will notify you 15 calendar days beforehand, and this modification is without prejudice to your right to terminate the Agreement with immediate effect at any time as set out in Articles 4.1 and 4.2 above.
